The huge boom crashed down across two city blocks in TriBeCa in February.<\/p>\n<\/div>\n<div class=\"dateline\">\u00a0The Department of Labor has hit the operator, Galasso Trucking and Rigging with two serious violations blaming the company for &#8220;not having any procedure or policy&#8230; regarding wind, ice and snow.&#8221; Another violation specifically faults the operator saying,&#8221; manufacturers procedures were not followed because the boom angle was lowered below 75 degrees.&#8221;<\/div>\n<div class=\"dateline\">\n<p>&#8220;They basically did nothing right when they started lowering that boom,&#8221; said crane expert Thomas Barth.<\/p>\n<p>Barth said in the rush to get the crane&#8217;s huge boom out of the wind, they neglected the crane&#8217;s safety manual.<\/p>\n<p>&#8220;The load charts were the bible to follow and they were not followed that&#8217;s correct,&#8221; Barth said.<\/p>\n<\/div>\n<div class=\"dateline\">\u00a0Eyewitness News Investigators have also learned that two days before the fatal collapse, a city inspector had visited the site to inspect the crane to see if it were safe to operate. But upon arrival, the crane was already in use. Galasso was fined $800.<\/div>\n<div class=\"dateline\">\n<p>&#8220;These fines are a pittance to construction workers and companies,&#8221; said Susan Karten, a construction safety attorney.<\/p>\n<p>Karten won a huge settlement for a family whose son was killed in a 2008 crane collapse. She said the fines for unsafe operations are so weak they do little to hold a company accountable.<\/p>\n<p>&#8220;It&#8217;s a slap on the wrist and business is back to usual, so I have a real big beef with the fact that these fines just get paid and nothing changes,&#8221; Karten said.<\/p>\n<p>We&#8217;ve learned the operator is contesting the violations and the $22,000 in fines. They did not return our calls for comment.<\/p>\n<p>The New York City Buildings Department told us their investigation is ongoing. In the meantime, they&#8217;ve banned from operation any crane, like the one in the accident, when winds exceed 20 miles per hour.
