{"id":550,"date":"2016-04-14T16:11:58","date_gmt":"2016-04-14T16:11:58","guid":{"rendered":"http:\/\/minutes.machine.market\/?p=550"},"modified":"2016-04-14T16:11:58","modified_gmt":"2016-04-14T16:11:58","slug":"federal-appeals-court-oks-navajo-mine-operation","status":"publish","type":"post","link":"https:\/\/machine.market\/blog\/federal-appeals-court-oks-navajo-mine-operation\/","title":{"rendered":"Federal appeals court OKs Navajo Mine operation"},"content":{"rendered":"<p>FARMINGTON\u00a0\u2013\u00a0The U.S. Court of Appeals for the 10th Circuit\u00a0in Denver has vacated and dismissed last year\u2019s federal court decision that halted operations in Area IV North\u00a0at the Navajo Mine.<\/p>\n<p>On Wednesday, a three-judge panel dismissed an appeal the Navajo Transitional Energy Company filed in 2015 as &#8220;constitutionally moot&#8221; and vacated an opinion, order and final judgment a federal judge in Colorado issued last year.<\/p>\n<p>U.S. District Court Judge John L. Kane\u00a0rejected the U.S. Office of Surface Mining Reclamation and Enforcement&#8217;s approval in 2012 of mining operations in 714 acres of Area IV. He later ruled the office&#8217;s approval violated the National Environmental Policy Act because it did not\u00a0consider the impacts of burning coal at the Four Corners Power Plant.<\/p>\n<p>In addition, the federal appellate\u00a0judges\u00a0determined they\u00a0lacked jurisdiction on the appeal because the Office of Surface Mining, in accordance with the district court&#8217;s remand, issued a revised Environmental Assessment for Area IV North in October.<\/p>\n<p>The decision was reached after the three-judge panel determined an oral argument was not necessary for the appeal.<\/p>\n<p>The\u00a0Navajo Mine, which is owned by NTEC, is the sole provider of coal to the Four Corners Power Plant.<\/p>\n<p>In a press release on Thursday, NTEC stated the halt in operation\ufffd\ufffdcost the company and the Navajo Nation\u00a0approximately $2 million, and mining operations elsewhere at the Navajo Mine\u00a0moved to seven days a week during\u00a0the closure in order to provide the coal needed for the power plant.<\/p>\n<p>NTEC CEO Clark Moseley\u00a0welcomed the federal appeals court decision in the press release.<\/p>\n<p>\u201cNTEC is very pleased with this outcome on appeal. As a company of a sovereign nation, we can continue doing work to secure Navajo Nation\u2019s self-determined future,\u201d Moseley said.<\/p>\n<p>He added, \u201cThe unfortunate decision of the Colorado District Court last year is no longer on the books, and NTEC can now move on with its operations on behalf of the Navajo Nation.&#8221;<\/p>\n<p>Mike Eisenfeld\u00a0of the San Juan Citizens Alliance, one of the plaintiffs in\u00a0the original lawsuit,\u00a0said he was disappointed but not surprised by the federal appeals court decision.\u00a0He said attention now turns to legal\u00a0action against the Office of Surface Mining, the U.S. Fish and Wildlife Service, and other federal agencies for approving the Four Corners Power Plant and Navajo Mine Energy Project in July 2015.<\/p>\n<p>The San Juan Citizens Alliance, along with Din\u00e9\u00a0CARE\u00a0and four additional environmental\u00a0groups,\u00a0filed a 60-day notice of intent to sue in December, citing\u00a0violations of the Endangered Species Act and claims under the National Environmental Policy\u00a0Act.<\/p>\n<p>&#8220;Although the court&#8217;s decision is disappointing, there essentially is no reversal or ruling on the merits of our case,&#8221; Lori Goodman\u00a0of Din\u00e9 CARE\u00a0said about Wednesday&#8217;s decision.<\/p>\n<p><em>Noel Lyn Smith covers the Navajo Nation for The Daily Times.
